Risk Management Round Table
An effective Risk Management and Safety Program are essential to the day-to-day operations of any long term nursing facility. Not only will this training session recommend ways to help protect residents and staff, it will also provide ways of helping a facility save money in medical, worker’s compensation and litigation costs. In addition, the training session will focus on how a Risk Manager provides help and guidance to accomplish these goals. Further, the training session will provide guidance in determining the effectiveness of a facility’s safety committee, and provide recommendations on how to improve existing committees.
(There will be a 15 minute breaking in the middle of this session so the total credits that can be earned will be THREE)

Medicaid Eligibility & Transfer Penalties: What Steps Should Facilities Take to Maximize Chances of Obtaining Payment?
As the changes ushered in by the Deficit Reduction Act are implemented, there is an increase in the transfer penalties assessed against Medicaid applicants. Long term care facilities need to know what steps to take to protect their rights to request an undue hardship waiver and/or appeal the transfer penalty. The presentation will focus on the three options of obtaining payment in the event of a transfer penalty: the undue hardship waiver request, appeal of the transfer penalty, and private pay resources. The presentation shall include a discussion of the necessary procedural safeguards, actions to be taken prior to a hearing, recent decisions, and resolutions. The presentation will also discuss potential revisions to the Admission Agreement and related documents.

Home and Community Based Services – An Expansion of the Continuum
This session will review the legal implications of developing a Home and Community Based Services provider. Corporate restructuring, regulatory and risk management issues associated with creating a Home and Community Based provider will be discussed. The presenter will address the licensure requirements for home care agencies and home care services required under Act 69 and the Department of Health's regulations. The session will discuss operational issues, including the development of contractual arrangements with consumers and developing a “referral” base in the local community. The basic framework for the development of a PACE program also will be explained.

An Integrated Approach to Managing Resident Behavior and Caregiver Stress in a Dementia-Care Setting
This presentation will provide an overview of the Leader-Effect® Dynamics program for teaching leadership, ancillary and direct-care staff to work effectively as a team in managing the behavior of residents with dementia, while minimizing the stress that is often associated with caring for this difficult population. The program uses a series of true-to-life case studies to (1) enhance knowledge of dementia and its effects on behavior and cognition, (2) illustrate the use of 12 evidence-based behavior management skills, and (3) highlight communication and supervision issues that often diminish the effectiveness of behavior management efforts and increase stress on staff. Workshop sessions are followed by group coaching sessions during which behavior management programs for current residents are developed, implemented and evaluated.

MDS 3.0
In preparation for the implementation of the MDS 3.0 in October 2010, the Office of Long Term Living is considering changes to the Case-Mix Reimbursement System so that it is compatible with the 3.0. They will present an update to the membership on the status, including how picture dates information will be determined. They will discuss the basic Case-Mix Index report that members have been using for many years as well as the Latest assessment Roster Report which may be the vehicle used to generate Case-Mix Index reports using the latest assessment. The Shadow Rate letter and version 5.12 of the Resource Utilization Group will also be discussed.

Effective Behavior Management: Assessing Your Needs & Implementing the Right Program
This program will address the on-going issues of how to effectively manage resident behavior problems in long-term care, in particular the county homes. County homes are frequently challenged with a mix of younger residents with complex medical problems who exhibit care needs much different than our typical resident population. Meeting the care needs of this special population requires additional education, training, and support of our staff. Residents with complex medical issues that significantly affect mood and behavior are more likely to reside in our communities creating the need for different and sometimes additional resources to effectively manage resident care. The presenters will provide strategies for improved behavior management programming through critical analysis of the resident population. Accurate assessment of your special resident populations is the key to effectively structuring the environment, culture, programming, and approaches to adequately care for residents with special behavior needs.

Medicare 2010 How to be Prepared to Miminize the Impact

Legislative Update
PACAH’s Executive Director will provide an update on the challenges facing the Association in the months ahead and discuss the priorities from a legislative and administrative perspective. Over 125 pieces of legislation are currently being monitored by PACAH and those most likely to see action by the House and Senate will be discussed. The time frame for implementation of the “Never Events” law will be reviewed, as well as the county immunity ruling pending before the Supreme Court, and current status of assisted living and home care regulations. The impact of the county share will also be discussed as it relates to the budget and certified public expenditure process.
